SHAMOKIN — Scott J. Binsack’s lawsuit against the city, city officials and the state parole board was dismissed Friday in federal court, 10 months to the day that it was filed.
U.S. District Judge Matthew W. Brann wrote in his order that a motion to withdraw filed Aug. 13 by Binsack, of Shamokin, will be treated as a dismissal.
Defendants’ subsequent motions seeking to block the withdrawal were “denied as moot.” The defendants had wanted to proceed in defense of Binsack’s claims that they violated his constitutional rights.
Binsack sought a withdrawal of his original complaint, according to his motion, in light of “ongoing constitutional violations” that, he said, require the filing of two new separate actions that involve state parole, city clerk Steve Bartos and The News-Item.
